4th Circuit Court Rules on Mid-Currituck Bridge

A three judge panel of the U.S. Court of Appeals for the Fourth Circuit released its decision today on the appeal of the opponents of the Mid-Currituck bridge of the December decision by the U.S. District Court for the Eastern District of North Carolina. The decision of the circuit court was upheld, meaning that NCDOT and the FHWA can proceed with the bridge.

You can read the 21-page decision, double spaced, here:

The appellants, the "NO MID-CURRITUCK BRIDGE-CONCERNED CITIZENS AND VISITORS" and the North Carolina Wildlife Federation have two choices for appeal: they may ask for the entire Fourth Circuit Court to hear the case (en banc) or appeal to the Supreme Court.

The bridge doesn't affect me, since we don't go up to that part of the coast anyway. But am I correct in understanding that the stated purpose of the bridge is to enable quicker evacuation in the event of a hurricane, but that in reality it will just make it easier for more people to come to an area that is already overcrowded?

It's stated purpose from the DOT website:
"The Mid-Currituck Bridge project would create a second crossing of the sound – north of the Wright Memorial Bridge – to help alleviate congestion and improve the flow of evacuation traffic in the event of a hurricane or severe storm.

It would also provide easier access between the Outer Banks and Virginia, as well as other communities in northeastern North Carolina. "

I would potentially ease some congestion, increase day visitors to non-mainland parts of Currituck, and add an evacuation route, but as designed it would need to be a flow revered route for egress in an evacuation, and the length and composition of the bridge would require earlier evacuation over it and earlier wind related closings with an approaching storm, so who knows how effective that would be.

I've got no dog in the hunt but I'm curious if you think it'll continue to be delayed or if will go ahead? I can't imagine the extra flow of people who would be coming in if that bridge is built. Corolla would be even closer to becoming the next Myrtle Beach! I understand the need for a better evac route but still, if they build it THEY WILL COME.

It ever being built is predicated on a large increase in traffic as its funding scheme requires the bridge generating significant toll revenue for the majority of the cost of the bridge construction.

And that's a helluva lot of toll money.

RE: 4th Circuit Court Rules on Mid-Currituck Bridge

I just wonder how the cost of the bridge is justified for 3 mo. out of the year. I know its hard to get thru Duck but I cant see that it will make sense to spend that kind of money.

RE: 4th Circuit Court Rules on Mid-Currituck Bridge

I just can't understand how to bridges leading to the same road heading north will speed up evacuations. And also can't see how people heading to their vacation heading south and hopping on the mid county bridge will work while still needing to drive through Duck. My motto is be careful what you wish for because it might come true and not be what you imagined.

#1: Because you don't have to go down through Duck, over the WB bridge and up 158.

#2: People heading to Southern Shores and South won't use the Mid county bridge. Think a little.

RE: 4th Circuit Court Rules on Mid-Currituck Bridge

The number of cars that use the bridge is going to be highly dependent on the toll. The volume of cars that go around the toll on the 168 expressway is tremendous so they can have an extra drink with an umbrella in it. The bridge could be a lonely place if the toll is to high and could have zero cars in the off season.

When I drive from Kitty Hawk to Virginia, I never take the toll road going or coming. I always exit at the last exit before the toll. You only lose about 10 minutes to save that three bucks. Furthermore, the Wawa at Hillcrest usually has the cheapest gas in the whole area, so there you can save another several dollars.

However, to not take the Currituck toll bridge to Corolla on a changeover day, you could lose three hours time and pay a lot more money to burn up a lot more gas. I personally would pay a pretty high toll price to escape that.

That Wawa is a ****show on Saturdays May- October. I still skip the toll road on principle.

RE: 4th Circuit Court Rules on Mid-Currituck Bridge

Anyone have an idea of how much the total price will be?

I never make the trip on Saturdays at that time of year, but my guess is that the tollbooths can back up also.

Harbinger to Adylet is 16.4 miles. Both bridges will have heavy traffic leading to the same road, Rt. 158 to head north. I'm thinking but can't figure out how the mid-Currituck bridge won't cause a snarl less than 17 miles up the road. Key word - Evacuation.

I have read as high as $25.

I live 3 miles from the Wawa. The Murphy is almost always less and not a mess with cars.

RE: 4th Circuit Court Rules on Mid-Currituck Bridge

At least drivers will have a nice view sitting in a backup on the bridge. Until 12 is widened to 4 lanes, the traffic jams will continue. Expect the land on the east and west side of the bridge to be re-zoned commercial to add to the traffic problem with more traffic signals.

We do the same. The Wawa is a very convenient stopping point to re-fuel and take a restroom break.

I had guesstimated 30 which would still be a helluva bargain for a family driving from way up north to the Currituck Banks for a vacation.
