I supported the out of town owners. They fought to get an agreement that would prevent loss of access to their property in the future.

But then they tried to "cash in" and get paid "damages". I'm glad they failed in that.

Those were different things and different owners.

Had the owners not been willing to settle with the county for court costs, the County would have been footing damages and much higher court costs.

I wasn't a party to either, though I did have actual damages to the tune of over $12k.

Honestly, the most troubling point is that even though the County knew in advance their action was unconstitutional (and that's why other barriers didn't do the lockout nonsense) they wasted taxpayer dollars to appease a group of outsiders whose only goal was to drive a wedge in the community.

I wouldn't use the term "cash in"
We had 4 rentals that we personally refunded 100% because travel insurance either would not cover it or would not decide because a closing based on a pandemic closure was not part of the policy. After the May 15 opening the other issue was the homes were not ready for rental because maintenance workers could not or would not go open them up before the rentals arrived.
In our case We literally got off work and drove down and spring cleaned the home over 2 days. We also bought 3 extra sheet sets for every bed so that nothing would be reused on turnover days along with hundreds of dollars in cleaning products and extra cleaning supplies for the cleaner and each new guest. If they were asking for the actual costs or losses have no problem with that,

Yes. From the OBV article:

“ This Blackburn case is not the first legal battle over the county’s COVID closure. In 2020, plaintiffs sued, claiming the county violated their Constitutional rights by denying non-resident property owners access. In a settlement, the Dare Commissioners agreed that in future public health emergencies, the county would classify non-resident property owners the same way as residents. Without making an admission of fault or liability, the county also agreed to pay $16,500 in legal costs.”

Not just maintenenance. Lots of owners has renovations underway or repairs half completed.

It get lost in the hot tubs and heated pools and in the McMansions, but lots of homes are still 100% owner repaired, run, and maintained.A fair number of owners travel down every weekend for months to make repairs and upgrades.

And, to add insult to injury, the illegal closure was made public not until such time as people working a 9-5 and traveling from within a 5 hour radius were already halfway to the Outer Banks.

I scrambled and got those traveling on 64 a good deal on some rooms in Williamsburg for the night, but a lot of them were already closer to the bridge, and with supplies like TP in tow and their own power tools. The hotel was super nice about helping them secure those belongings, but it was an expensive mess.

It was surreal here without tourists. I have pictures of the bypass in KDH with not a single car in sight. Most of the smaller stores were closed as well.

We lucked out on the closure as NRPOs. We only rented our home anyway during the summer months and had come down mid March as I was recently retired and decided to stay a bit in case the island wasn't opening for awhile. I mean....we didn't know what was going on with the virus and thought we'd be better off on Avon.

I felt sorry for the people that couldn't get to their homes though. We stayed for six weeks and weather was great. I could ride my bicycle down 12 with hardly any cars and didn't have to share the beach with many people. Some days, we were the only ones on the beach.

We were lucky in that we arrived 48 hours before they shut the Wright Memorial Bridge down to NRPOs. Felt bad for all that couldn't get here or who were in route (after driving for hours) only to be turned away at the the bridge. We were "stuck" in Corolla for 12 weeks. We didn't want to cross the bridge to the mainland bc we knew we could not come back until the closure was lifted. I completely understand the NRPO's position regarding paying taxes but being unable to reach their home. Not knowing what was going on at your home and not being able to access it must have been infuriating! That being said, it was the most peaceful 12 weeks I've ever spent anywhere. We would go for 2 hour walks on the beach and not see a single soul. In some ways, it felt like time stood still or that the world had ended. And for those who are wondering, YES, Food lion and Harris Teeter had plenty of TP Tounge smiley

Were you guys down for the "great power outage" of 2017? Very similar time. Craziest part was that the weather turned unseasonably cool for that week...low humidity, low temps cool breeze allowed windows open all week.

An economic disaster for many (although PCL made, to my knowledge, everyone whole) but just an incredible week.

We were not down then since we rented our cottage during summer months. We refunded our renter as it was beyond their control. Yes...that was when the power was cut while working on the bridge, if I remember correctly. Sometime around first of August I'm thinking. Crazy!

We live in Currituck but own long-term rental property in Dare. We cannot get onto the OBX as we don't have priority status.

Huh? Unless I'm off base (quite possibly) the Dare GIS Record data/your tax bill will afford you the same priority as any other non resident property owner...which is 2nd now, I think (after 1st Responders/Critical Needs). Previous to the '20 county border covid closing wasn't the 2nd group only local DLs and NRPO's third?

Copy, thanks. I thought one of the "outcomes" from the court case was that NRPOs (3) were now grouped w local DL and critical workers (2)? Candidly, I think (not a popular view point, I know) it's a good idea to have them remain separate. I think most on here know just how FUBAR this place can be post event and would re enter thoughtfully and bring everything they need to be self sufficient for a while ...but, they are in the minority.

I thought there was a suit based on the notion of blocking state roads by government officials who were picking and choosing who could come and go using weather related policy, when no weather event existed. Property owners or those who clean and cook for the property owners are allowed, others were not,

I still don't understand NRPOs not having the same rights as RPOs.
