Beach is the one threating and calling people names , sounds like a Middle School bully ! I have posted Wills rules as a reminder !!


The rules are greatly relaxed now and the forum is largely unmoderated. there are really only two things that will get you banned:

1. Making physical threats against someone.
2. Posting anyone's name, address or phone number with the intent of inciting someone to harrass / harm that person.

Other than that, the gloves are off. I am not going to delete any posts that don't violate the two rules posted above, unless they are totally off topic for this forum. The community is going to have to police itself and, if you don't have a thick skin, I suggest ignoring certain threads.

Second where the hell did I threaten anyone? You're a liar. lol All I said was if I'm someone's "little buddy" and you'd like to prove this accusation of weakness feel free to bring it. (; I even gave you the option of bringing friends! I thought that was rather generous. See, most people don't just bring insults like that up in polite society because there is a mutual understanding that it could escalate. You however, hiding like a little weakling, weasel like to taunt people on line hiding behind your keyboard in the safety of your own home. How does that feel?? Do you feel powerful? lol Not to mention I hadn't said a word to you or even commented on this post. This is all you do here, you know that? In person you would be sweet as pie to me. That's exactly what I just asked you. Can't you come up with something original? ...I joined the OBX Forum because I live, own property and work here and I happen to like 99% of the people who post here Izzy. I enjoy sharing my experiences here because I respect and enjoy other people who do the same kinds of things. People here contribute to my life with suggestions , encouragement and friendship. I'm sure some of my posts are boring to people but there are lots of other posts and points of interest here for everyone. My family members travel and work quite a bit so I'm alone often and appreciate the friendships I've made here. It fills a void when I look out at the beauty around me or I'm working on a project here and have noone to share it with because my loved ones are away. I'm not afraid to admit that. Why do you post here, because I never see you post anything....you only respond to other people's posts when you feel like criticizing or correcting someone. I guess that's a good time for you, huh?

Well, a reasonably innocent question on my part certainly took a left turn. Thinking of the question I certaily should have considered the ADA implications. In my work career, crews I was in charge of literally built 100's of ADA ramps and sidewalks in PA & NY. While I know we are discussing a wooden walkway in NC , the ADA rules are federal. Did not consider those implications when all I really wanted to know was who was responsible, or approved a haljf baked repair to steps on the bottom of a beach access. Now then, thinking about it I see at least three scenario's-
1. I can see a how walkway from a private house that doesn't infringe onto federal land can pretty much do what they want.
2. I don't know how a "community walkway" open to the general public can avoid the ADA rules, regardless of where it exits.
3. A public walkway exiting or infringing onto federal land should have to comply with the ADA rules.
Given that the federal/state land begins at the high water mark which is a fairly open description, lets say that most of the public walkways probaly fall into the ADA baliwick.
Of/On the projects I was aligned with - all using public funds, the argument of cost was WAY, WAY down on the list of exceptions to be exonerated for compliance. Most of the ramps I have seen on the island could -(yes could ) be constructed to ADA spec's. The landscape on the shore is reasonably flat - except for the dune hump. Extending a ramp parallel to the shoreline instead of steps gets you in compliance. Cost - for sure. But at least your talking only about pressure treated lumber, fasteners, and labor. No concrete, steel, trees or major heavy equipment required.
Not my intention at all to cause any constrenation, or start a war on ADA. I can just see now however on how a small bit of shoddy construction can be a huge issue.

One correction here... the vast majority of the walkway in question in this thread IS actually located on Federal land. You can see it on the Dare GIS image. It's the walkway on the left in the photo. The Federal land boundaries are indicated in red.

So are you saying you got a permit from Superintendent Hallac for the recent work that ALTERED the walkway (narrowed part of it by 1 ft), which was noticed by the renter who started this thread?

So you DID NOT get a new permit from the NPS to ALTER the walkway. That's the problem. Repair is acceptable. But in this case the walkway was ALTERED, making it 1 ft more narrow. Do you have an NPS permit for that alteration?

Let's move on from this. Lowtide gets a wakeup call and he and/or his contractors can't just do whatever the hell they wish and ignore NPS requirements.

The walkway gets repaired preserving the prior walkway width parameters.

How does anyone lose in that scenario?
