RE: Court Rejects Completion Woman's Massive NC Home

This sure doesn't look like a single family house. It looks like a motel. Glad the court ruled against her, but why wait till it was 95% complete. Did someone file a lawsuit against her? It's just crazy. 4.6 million???? Some people are just plain nuts.

RE: Court Rejects Completion Woman's Massive NC Home

I thought the courts in NC approved them finishing this house known as the Chesapeake. It is currently listed and available for rent here: https://www.twiddy.com/outer-banks/4x4/ocean-beach/rentals/the-chesapeake/#/FOOzHpBeQPCxkUI107_eEQL/

RE: Court Rejects Completion Woman's Massive NC Home

I thought it was a done deal, too, and going forward to completion. Last thing I expected to have pop up on NECN, my computer home page here in MA. Theeth smiley

Here's the case, in case anyone's interested in ready the court's opinion...

only 2 weeks rented so far....

wonder how they were able to rent it and get an occupancy permit with litigation still in place?

RE: Court Rejects Completion Woman's Massive NC Home

24 bedroom rental home? Nonsense but its already built. What now? If the appeal fails does get it torn down or become a $4.6 million dollar abandoned home?

RE: Court Rejects Completion Woman's Massive NC Home

Wow, after seeing all those pictures! It really is a beautiful place. Looks finished to me. But how many people need 24 bedrooms? I know people go with big groups, but this is way over the top. Would be nice for a wedding party, etc, but how many events like that go out to the 4x4 drive area? It's a spectacular place alright, but the prices Weozza!!!

RE: Court Rejects Completion Woman's Massive NC Home

Good, I'm glad. A twenty four bedroom house is absurd. Some people have more money then sense. That's one yankee that needs to go back up north.

MARi

Yes, it's absurd alright. How can she claim it's a "single family" home with that many bedrooms.

RE: Court Rejects Completion Woman's Massive NC Home

I haven't been following the case, but reading the court's opinion it sounds like the owner argued to the county that it was a single structure, and argued to CAMA that it was three separate structures less than 5000sf each.

The county initially concurred that it met the definition of a "single family detracted dwelling" because it was a single structure with continuous conditioned air, even though it was on separate foundations. A neighbor challenged the county's determination, but since the county issued permits, the owner started building, in spite of pending legal action. Since then it's gone back and forth through the legal process.

As I understand, ultimately the county can order the owner to tear down as necessary to meet compliance if the owner is unable to obtain a zoning variance.

The County facilitated and allowed this to go forward with vi$ion$ of sugarplums in their head. Whether you agree or not, it sounds like the owner is getting a BOHICA.

I think the visions of sugarplums were shared by both the County and the owner. When the owner started building, it was clear that the neighbor was legally challenging the county’s determination. The owner had to know there was the possibility that the neighbor could successfully stop things in the court. The owner figured that she was in a better position if she started work, figuring no court would order her to tear down the building. Looks like she was wrong.

"That's one yankee that needs to go back up north." Is this really pertinent?

RE: Court Rejects Completion Woman's Massive NC Home

^^ I thought the same thing. I mean, a southerner building an unnecessarily large fancy home? Crazy. *Cough Cough*

Regardless, the size doesnt seem to be the issue, its location. Something about proximity to the ocean..not sure if it needs to be closer to it or further from it but there was a good article in the Charlotte Observer about it this morning.

One court said yes and the next court, going up the ladder, said no. Typical for our crazy court system.

There is a 22 bedroom house across the street from what was the Port O Call assessed at 3.6 million and owned by a Texan.

That's exactly what she was thinking. I wonder if there is a lender involved, and if so, what they thought of her strategy...

RE: Court Rejects Completion Woman's Massive NC Home

With the recent court ruling, where EXACTLY does this stand? It's being rented so the fact that it isn't 100% completed doesn't seem to be an issue.

It stands that two law firms will continue to bill large legal fees on this case.

RE: Court Rejects Completion Woman's Massive NC Home

The house is finished, and frankly, the more I read the more confused I feel. Beat up

$4.6M? Peanuts. Look at seasonal/vacation property in Jackson Hole WY and Big Sky MT. $5-7M for 10-11 BR is not hard to find. And 3,000 sq ft is small out there....

RE: Court Rejects Completion Woman's Massive NC Home

She is a absolute idiot to have started the construction with out the approval of all her plans and issuance of the permits. The train wreck that has followed is all her own doing.

Yes, that is my guess too. She will finish it against court orders and fight it in the court system while she rents it for huge sums of money. It's the American way.
